  63.           This agreement explains when and how you may use both shareware
  64.           and registered copies of software products from Himalaya Software.
  65.           In this agreement:
  66.  
  67.           *  Program means the Himalaya Software software products(s) you
  68.              have purchased or obtained for evaluation, including both the
  69.              software and the associated documentation and other materials;
  70.  
  71.           *  Shareware Copy means a copy of the Program distributed by us
  72.              for evaluation purposes and which is described as a shareware
  73.              copy in the Program's sign-on messages;
  74.  
  75.           *  Registered Copy means a copy of the Program purchased from us,
  76.              and which is not described as a shareware copy in the Program's
  77.              sign-on messages;
  78.  
  79.           *  we or us means Himalaya Software, a corporation based in
  80.              Pijnacker, The Netherlands; and
  81.  
  82.           *  you means the end user of the Program.

  85.           Legal Agreement
  86.  
  87.           This is a legal agreement which allows you, the end user, to use
  88.           the Program under certain terms and conditions. If you cannot
  89.           agree to abide by what this agreement says you should not use or
  90.           evaluate the Program.

  92.           1. Copyright
  93.  
  94.              The Program is fully protected by copyright under Dutch law and
  95.              international treaty provisions.

  97.           2. Evaluation Period
  98.  
  99.              You may use a Shareware Copy of the Program for an evaluation
  100.              period of up to 21 days, in order to determine whether the
  101.              program meets your needs  before purchasing it. Once  the
  102.              evaluation period ends, you agree to either purchase a
  103.              Registered Copy of the Program, or to stop using it. If you
  104.              have ordered a Registered Copy of the Program from us, you may
  105.              continue to use your Shareware Copy until your Registered Copy
  106.              arrives.

  116.           3. Use of the Program
  117.  
  118.              While you are evaluating the Program, you may use it on as many
  119.              computers as are required to perform your evaluation. Your
  120.              21-day evaluation period begins when you first install the
  121.              Program on one or more computers for evaluation purposes. Once
  122.              the evaluation period is over and you purchase the program,
  123.              your use is subject to the following restrictions:

  125.              A. You agree not to install or use any individual copy of the
  126.                 Program on more than one computer at a time. This does not
  127.                 permit you to: (a) use the software on a network, (b) rent
  128.                 or lease the software, (c) reverse-engineer, decompile,
  129.                 disassemble, or otherwise modify the software, (d) copy the
  130.                 software except to make a single copy for archival purposes
  131.                 or to transfer the software to a fixed disk. (If the Program
  132.                 was purchased by your employer you agree to get your
  133.                 employer's explicit permission before installing the Program
  134.                 on multiple computers as described above.)

  136.              B. If you purchased additional licenses for the Program you
  137.                 agree not to install or use it on more computers than the
  138.                 number included in your license, as shown on your invoice,
  139.                 the program sign-on screen, or other documents from us.

  141.           4. Making and Distributing Shareware Copies of the Program
  142.  
  143.              You may make copies of your Shareware Copy of the Program to
  144.              give to others, as long as you include all of the files that
  145.              you originally received with your Shareware Copy. When you give
  146.              a Shareware Copy of the Program to another person, you agree to
  147.              inform them that their copy is to be used for a time limited
  148.              evaluation period, and that they must purchase a Registered
  149.              Copy if they continue to use the Program once the evaluation
  150.              period has ended. You agree not to sell Shareware Copies of the
  151.              Program or distribute them to others for any kind of
  152.              compensation or fee.

  154.           5. Copying Registered Copies of the Program
  155.  
  156.              When you receive a Registered Copy of the Program you may make
  157.              copies of the Program software which are necessary for normal
  158.              backup purposes. You agree not to make any other copies of the
  159.              software, the manual(s), or any part of them, or sell or give
  160.              any copies to others, without our advance written permission.

  171.           6. Operation of the Program
  172.  
  173.              The Program offers powerful capabilities. If you do not follow
  174.              our instructions, or if you use the Program improperly, you can
  175.              destroy files or cause other damage to your software and data.
  176.              You assume full responsibility for the selection and use of the
  177.              Program to achieve your intended results.

  180.           Limited Warranty
  181.  
  182.           The following limited warranty applies to Registered Copies of the
  183.           Program. It is included here so you understand what your warranty
  184.           will be when you purchase a Registered Copy. This warranty does
  185.           NOT apply to Shareware Copies of the Program.

  187.           7. Physical Defects
  188.  
  189.              We pledge that the disks and manuals we send you will arrive
  190.              free of physical defects which interfere with normal use. If
  191.              you find such a defect and report it to us within 90 days after
  192.              you purchase the Program, we agree to replace the defective
  193.              item(s) at no charge to you as long as the defect was not
  194.              caused by misuse or abuse. After 90 days, the media may be
  195.              replaced at a a reasonable service charge.

  197.           8. Bugs and Program Errors
  198.  
  199.              We don't promise that the Program will be free of bugs or
  200.              program errors. If you report a program error or bug to us, we
  201.              will use our best efforts to correct it. If we issue a
  202.              maintenance release for the Program which includes a correction
  203.              for an error you reported, we will send you a copy of that
  204.              maintenance release at no charge if you request it. We will
  205.              only do this for maintenance releases, not for new major
  206.              releases or other new versions of the Program.

  208.           9. Satisfaction Guarantee
  209.  
  210.              If you are dissatisfied with any product you buy from us under
  211.              this Agreement for any reason, you may return it at any time up
  212.              to 90 days after purchase and we will give you a full refund.
  213.              Refunds will be based on the price you paid, less shipping
  214.              costs. You must contact us before returning any product for a
